The website and Services are operated by Momfree, a brand of XINGHE INDUSTRIAL (HONG KONG)CO.,LIMITED ("Momfree," "we," "us," or "our"). Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer products and Services to you.

By accessing the website, placing an order, or otherwise using the Services, you agree to these Terms and the policies incorporated by reference. If you do not agree, please do not use the Services.

1. Eligibility and Online Store Use

You must be at least the age of majority in your state, province, or jurisdiction of residence to purchase through the website. If you permit a minor to use the Services, you are responsible for that use.

3. Prices, Promotions, and Taxes

Prices are displayed in U.S. dollars unless otherwise stated and may change without notice. A price change will not affect an order already accepted by us, except where correction is permitted or required by applicable law.

Discounts, promotional codes, gifts, and limited-time offers are subject to the conditions stated with the offer. Unless expressly permitted, offers cannot be combined, exchanged for cash, or applied retroactively.

Applicable taxes, shipping charges, and other order costs will be shown at checkout before you submit the order.

4. Orders and Acceptance

Your submission of an order is an offer to purchase. An order confirmation email acknowledges that we received the order but does not necessarily mean that the order has been accepted or shipped.

Payments are processed by Shopify and other payment providers. Those providers may apply their own terms and privacy practices. You authorize the applicable payment provider to charge the total displayed at checkout.

6. Shipping and Delivery

Shipping availability, estimated delivery times, fees, tracking, address responsibilities, and delivery issues are governed by our Shipping Policy.

Delivery dates are estimates and may be affected by carrier delays, weather, holidays, incorrect address information, and events outside our reasonable control. Nothing in these Terms limits any rights you may have under applicable delivery or consumer protection laws.

7. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are subject to our Refund Policy, including the hygiene restrictions that apply to opened or used breast pumps and other personal-use products.

8. Limited Warranty

Eligible products purchased directly from momfree.com are covered by our Warranty Policy. The limited warranty does not exclude or restrict mandatory consumer rights that cannot be waived under applicable law.

9. Accounts and Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through the account. Please notify us promptly if you believe your account has been used without authorization.

We may suspend or terminate an account when reasonably necessary to protect the Services, investigate misuse, or comply with law.

We may remove User Content that is unlawful, misleading, abusive, infringing, fraudulent, or otherwise violates these Terms. We are not obligated to publish or respond to every submission.

12. Prohibited Uses

You may not use the website or Services to:

• Violate any applicable law or regulation
• Infringe the rights of Momfree or another person
• Submit false, fraudulent, misleading, defamatory, abusive, or unlawful information
• Transmit malware, malicious code, spam, phishing material, or automated attacks

• Scrape, crawl, copy, reverse engineer, or interfere with the website except as permitted by law

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, we do not guarantee that the website will always be uninterrupted, error-free, secure, or compatible with every device or browser.

16. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any mandatory consumer protection rights.

To the maximum extent permitted by applicable law, Momfree and its affiliates, directors, officers, employees, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from or related to your use of the Services or purchase of a product.

Where liability may lawfully be limited, Momfree's total liability for a claim relating to a purchase will not exceed the amount you paid for the product giving rise to the claim. This limitation does not apply where prohibited by applicable law.

To the extent permitted by applicable law, you agree to indemnify and hold Momfree and its affiliates, officers, directors, employees, agents, contractors, licensors, service providers, and suppliers harmless from third-party claims arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.

18. Severability and Waiver

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain effective.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

19. Termination

These Terms remain effective while you use the Services. You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or when reasonably necessary for legal, security, or operational reasons.

Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law, will continue to apply.

These Terms and the policies linked from them constitute the entire agreement between you and Momfree concerning the Services and supersede prior communications concerning the same subject.

21. Governing Law

These Terms and any separate agreement through which we provide the Services are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.

This choice of law does not deprive a consumer of mandatory protections available under the laws of the consumer's place of residence. Any dispute will be submitted to a court of competent jurisdiction in Hong Kong, except where applicable consumer law permits or requires the dispute to be brought in another jurisdiction.

We may update these Terms to reflect changes to the Services, business practices, or legal requirements. The revised version will be posted on this page with an updated date. Changes apply from the date posted unless applicable law requires otherwise.
